บริษัท ดีทีจีโอ คอร์ปอเรชั่น จำกัด (“บริษัท”) เป็นบริษัทผู้เป็นเจ้าของ THE GIVERS NETWORK PLATFORM (“THE GIVERS NETWORK”) มีวัตถุประสงค์ที่จะใช้ THE GIVERS NETWORK เป็นสื่อกลางระหว่าง (ก) บุคคลทั่วไป (ข) ผู้ใช้งานที่เป็นสมาชิกของกลุ่มบริษัทดีทีจีโอ (“DTGO FAMZ”) กับองค์กร สปอนเซอร์ ผู้สนับสนุนและ/หรือองค์กรการกุศลอื่นๆ ที่เกี่ยวข้องกับการช่วยเหลือสังคม เพื่อปลูกฝังจิตสำนึกการช่วยเหลือสังคม การให้โอกาสด้านการศึกษา ด้านสาธารณะสุข และการรักษาสิ่งแวดล้อมในชีวิตประจำวัน ผ่านการใช้เทคโนโลยีการสื่อสารระหว่างกัน เมื่อท่านสมัครบัญชีผู้ใช้งานของ THE GIVERS NETWORK สำเร็จ ท่านจะถือว่ามีสถานะเป็น ผู้ใช้บริการของ THE GIVERS NETWORK (“ผู้ใช้บริการ”) และตกลงที่จะปฏิบัติตามเงื่อนไขและข้อตกลงการใช้บริการ THE GIVERS NETWORK ตามที่ระบุไว้ ในเงื่อนไขและข้อตกลงฉบับนี้


หากผู้ใช้บริการไม่ยินยอมปฏิบัติตามเงื่อนไขและข้อตกลงฉบับนี้ และฉบับแก้ไขเพิ่มเติมอื่นๆในอนาคต บริษัทสงวนสิทธิที่จะห้ามหรือไม่อนุญาตให้ผู้ใช้บริการดังกล่าวใช้ THE GIVERS NETWORK ได้ ทั้งนี้การที่ผู้ใช้บริการยังคงใช้ THE GIVERS NETWORK อยู่ ผู้ใช้บริการดังกล่าวจะถูกถือว่า ได้ยอมรับปฏิบัติตามเงื่อนไขและข้อตกลงฉบับนี้เสมอ


ผู้ใช้บริการรับทราบว่า นอกเหนือจากเงื่อนไขและข้อตกลงฉบับนี้แล้ว ในการใช้บริการ THE GIVERS NETWORK ข้อมูลส่วนบุคคลของผู้ใช้บริการจะถูกเก็บรวบรวม ใช้ เปิดเผย และจัดการข้อมูลส่วนบุคคล (รวมเรียกว่า “การประมวลผลข้อมูล”) โดยบริษัท เพื่อประโยชน์ในการให้บริการโดยบริษัทแก่ผู้ใช้บริการ ทั้งนี้ บริษัทได้กำหนด เงื่อนไขเกี่ยวกับการประมวลผลข้อมูลส่วนบุคคลดังกล่าวไว้ในเงื่อนไขข้อกำหนดนโยบายความเป็นส่วนตัว


1.   การใช้บริการและการทำงานของ THE GIVERS NETWORK



ภายใต้การทำงานของ THE GIVERS NETWORK บริษัทตกลงให้บริการดังต่อไปนี้แก่ผู้ใช้บริการ และองค์กรที่ตกลงใช้บริการของ THE GIVERS NETWORK ของบริษัท (“องค์กร”) ในการจัดทำกิจกรรม จิตอาสาเพื่อปลูกฝังจิตสำนึกการช่วยเหลือสังคม การให้โอกาสด้านการศึกษา ด้านสาธารณะสุข และการรักษาสิ่งแวดล้อมในชีวิตประจำวันและการบริจาคต่างๆ (“กิจกรรม”) ทั้งนี้เพื่อหลีกเลี่ยงข้อสงสัย องค์กรต่างๆ เป็นผู้กำหนดเงื่อนไขและกฎเกณฑ์การเข้าร่วมกิจกรรมที่จัดโดยองค์กร การให้คะแนนของแต่ละกิจกรรม และการแลกของรางวัลที่จัดโดยองค์กรหรือสปอนเซอร์ทั้งหมด (“แคมเปญ”) โดยบริษัททำหน้าที่เพียงสื่อกลางในการดำเนินการดังกล่าวเท่านั้น


1.1  THE GIVERS NETWORK เป็นเครื่องมือสื่อสารในระบบการสะสมคะแนน (ต่อไปเรียกรวมกันว่า “คะแนน”)  สำหรับผู้ใช้บริการ ใน 2 ประเภทคะแนน (1) ค่าประสบการณ์ (Experience Points หรือ EXP ต่อไปเรียกว่า “คะแนนประสบการณ์”) ซึ่งเป็นคะแนนที่ผู้ใช้บริการอาจจะได้รับจากการทำกิจกรรมต่างๆ หรือตามเงื่อนไขและข้อกำหนดเกี่ยวกับการสะสมคะแนนเป็นคะแนนประสบการณ์ส่วนตัว หรือเป็นคะแนนประสบการณ์รวมของผู้ใช้บริการทั้งหมดที่อยู่ภายในกลุ่มหรือกิลด์หรือขององค์กรในภาพรวม โดยจะแสดงผลการร่วมกิจกรรมของผู้ใช้บริการแต่ละราย ซึ่งอาจส่งผลเป็นการสะสมคะแนนประสบการณ์รวมของกลุ่มหรือกิลด์ หรือขององค์กรในภาพรวม (2) คะแนนสะสมบุญ (Boon Points) ต่อไปเรียกว่า “บุญ”) ซึ่งบุญเป็นคะแนนสะสมที่อาจจะได้รับจากการทำกิจกรรมต่างๆ หรือตามเงื่อนไขและข้อกำหนดเกี่ยวกับการสะสมคะแนน โดย บุญ ไม่สามารถทำการซื้อ ขาย แลกเปลี่ยนระหว่างบัญชีผู้ใช้งานได้ หรือแลกเปลี่ยนเป็นเงินสดหรือสิ่งอื่นใด เว้นแต่สามารถนำไปใช้แลกรับของรางวัลหรือใช้ได้ตามเงื่อนไขที่จะได้กำหนดขึ้น


1.2  ให้บริการจัดทำระบบการสะสมคะแนน ตามเงื่อนไขและข้อกำหนดการสะสมคะแนนที่แต่ละองค์กรได้กำหนดไว้ ทั้งนี้ การให้บริการดังกล่าว อยู่ภายใต้เงื่อนไข ดังต่อไปนี้


ก.    องค์กรจะเป็นผู้มีอำนาจเพียงฝ่ายเดียวในการกำหนดเงื่อนไขและข้อกำหนดการสะสมคะแนน โดยบริษัท มีหน้าที่จัดทำระบบการสะสมคะแนนให้เป็นไปตามเงื่อนไขดังกล่าวเท่านั้น ดังนั้นบริษัทจะไม่รับผิดชอบ สำหรับปัญหาหรือข้อโต้แย้งใด ๆ ที่เกี่ยวข้องกับเงื่อนไขการสะสมคะแนนดังกล่าว​ ซึ่งผู้ใช้บริการต้องโต้แย้งไปยัง องค์กรผู้จัดกิจกรรมโดยตรง


ข.    การส่งข้อมูลการเข้าร่วมกิจกรรมเพื่อการสะสมคะแนน เป็นหน้าที่ของผู้ใช้บริการโดยตรง บริษัทมีหน้าที่ เพียงแสดงผลข้อมูลที่ผู้ใช้บริการเป็นผู้จัดทำเท่านั้น ดังนั้น ผู้ใช้บริการที่เป็นผู้ส่งข้อมูลการเข้าร่วมกิจกรรมผ่าน THE GIVERS NETWORK ต้องเป็นผู้รับผิดชอบความถูกต้องเกี่ยวกับข้อมูลที่ส่งเข้ามาในระบบเพียงฝ่ายเดียว โดยต้องรับประกันไม่ดำเนินการโดยการละเมิดสิทธิของผู้อื่น หรือเป็นการดำเนินการโดยไม่สุจริต ทั้งนี้ ผู้ใช้บริการและองค์กรเข้าใจและยอมรับว่าบริษัทไม่มีหน้าที่ในการตรวจสอบความถูกต้องของข้อมูลที่ส่งเข้ามาผ่านระบบ THE GIVERS NETWORK และหากข้อมูลดังกล่าวได้รับการส่งเข้าระบบตามเงื่อนไขที่องค์กรกำหนดแล้ว ระบบของบริษัทจะดำเนินการยืนยันการได้รับคะแนนสะสมจากการเข้าร่วมกิจกรรมให้แก่ผู้ใช้บริการที่เกี่ยวข้องทันที แต่การดำเนินการดังกล่าวไม่ถือเป็น การรับประกันใด ๆ โดยบริษัทสำหรับข้อมูลดังกล่าว


ค.    การยืนยันข้อมูลการเข้าร่วมกิจกรรมใดๆ สำเร็จ เป็นหน้าที่ขององค์กรที่จัดกิจกรรม และผู้กำหนดเงื่อนไขแคมเปญ หากเกิดข้อโต้แย้งระหว่างผู้ใช้บริการกับองค์กรที่จัดกิจกรรมและผู้กำหนดเงื่อนไขแคมเปญ บริษัท ในฐานะเป็นเพียงสื่อกลางในการส่งต่อข้อมูลเท่านั้น และจะไม่รับผิดชอบใดๆ และไม่ถือเป็นการยืนยันข้อมูลในการ เข้าร่วมกิจกรรมของผู้ใช้บริการฝ่ายหนึ่งฝ่ายใดที่ได้รับหรือส่งผ่านระบบมาอย่างถูกต้องภายในเวลาที่กำหนด บริษัทมีสิทธิตามข้อตกลงที่องค์กรได้ประกาศไว้ที่จะตัดคะแนนสะสมของผู้ใช้บริการดังกล่าวได้ โดยเป็นกรณีที่บริษัทดำเนินการไปตามเงื่อนไขที่องค์กรที่จัดกิจกรรมและผู้กำหนดเงื่อนไขแคมเปญกำหนดไว้ซึ่งผู้ใช้บริการต้องรับทราบและปฏิบัติตามอยู่แล้ว ผู้ใช้บริการที่ถูกตัดคะแนนสะสมดังกล่าว ไม่มีสิทธิจะโต้แย้งใดๆ กับบริษัทได้


ง.    ในกรณีมีการจัดกิจกรรมร่วมบริจาค ผู้ใช้บริการตกลงและยอมรับว่า องค์กรที่จัดกิจกรรมอาจจะขอข้อมูลอันจำเป็นเพิ่มเติมเพื่อประกอบการออกเอกสารหรือส่งมอบเอกสารหลักฐานใดๆ เช่น ชื่อ-สกุล ที่อยู่ เลขที่บัตรประชาชน หมายเลขโทรศัพท์ที่ใช้ในการติดต่อ เป็นต้น


1.3  ให้บริการจัดทำระบบการแลกบุญ เพื่อแลกรับของรางวัลจากการสะสม บุญ ดังกล่าว (“ของรางวัล”) ตามเงื่อนไขที่องค์กรอาจกำหนดขึ้น ทั้งนี้ ผู้ใช้บริการและองค์กรตกลงยอมรับและเข้าใจตรงกันว่า บริษัทไม่ได้เป็นผู้สัญญาว่าจะให้หรือเป็นผู้จัดหาหรือจัดส่งของรางวัลให้แก่ผู้ใช้บริการ แต่บริษัทมีหน้าที่แสดงยอดการสะสม บุญ เท่านั้น และเป็นแพลตฟอร์มในการแสดงเจตจำนงค์ในการแลกเปลี่ยน บุญ ของผู้ใช้บริการเท่านั้น ดังนั้น บริษัทไม่มีความรับผิดชอบใดๆ ในการรับประกัน ไม่ว่าจะทางตรงหรือทางอ้อมหรือการรับประกันตามกฎหมายใด ๆ ว่า ผู้ใช้บริการจะมีสิทธิหรือจะได้รับของรางวัล รวมถึงแต่ไม่จำกัดเพียงเรื่องกรรมสิทธิ ความสามารถในการซื้อขายได้ของสินค้าหรือบริการ ความสอดคล้องกับแบบสินค้า ข้อบกพร่องใด ๆ เกี่ยวกับสินค้าหรือบริการ คุณภาพที่น่าพึงพอใจ ความเหมาะสมสำหรับวัตถุประสงค์เฉพาะหรือการละเมิดลิขสิทธิ์ โดยผู้ใช้บริการต้องปฏิบัติตามเงื่อนไขการแลกของรางวัลที่องค์กรซึ่งเป็นผู้อุปถัมป์ ผู้สนับสนุนของรางวัล ผู้จัดรางวัล หรือ Sponsor (เรียกรวมกันว่า “สปอนเซอร์”) กำหนด และผู้ใช้บริการต้องใช้สิทธิเรียกร้องนั้นกับสปอนเซอร์ รวมถึงการจัดส่งของรางวัลที่สปอนเซอร์เป็นผู้คัดเลือกโดยตรง


2.   ชื่อผู้ใช้งาน (Account) และรหัสผ่าน (Password)


2.1 ผู้ใช้บริการตกลงว่าจะรักษาชื่อผู้ใช้งานและรหัสผ่าน รวมถึงรหัสประจำตัวไว้เป็นความลับและเป็นการเฉพาะบุคคล และจะไม่เปิดเผยให้ผู้ใดทราบ ทั้งนี้ บริษัทจะไม่รับผิดชอบต่อความเสียหายใด ๆ ทั้งสิ้น หากรหัสผ่านสูญหาย ผู้ใช้งานต้องดำเนินการเปลี่ยนแปลงรหัสผ่านทันทีได้ด้วยตนเอง หรือติดต่อ THE GIVERS NETWORK ทันทีตามช่องทางที่กำหนด และหากเกิดปัญหาจากการใช้ชื่อผู้ใช้งานหรือรหัสผ่านโดยบุคคลภายนอก โดยไม่ได้รับอนุญาต ซึ่งหากเกิดปัญหาดังกล่าว ผู้ใช้บริการต้องแจ้งให้บริษัททราบทันที โดยบริษัทจะดำเนินการระงับการทำรายการ และ/หรือการใช้ THE GIVERS NETWORK ทันทีที่ผู้ใช้บริการยืนยันตัวตนตามขั้นตอนและวิธีการที่บริษัทกำหนดไว้


2.2  ผู้ใช้บริการยอมรับว่าการทำรายการใด ๆ หรือการใช้บริการ THE GIVERS NETWORK ของผู้ใช้บริการที่ทำกับบริษัท ก่อนที่บริษัทจะระงับการทำรายการ และ/หรือการใช้ THE GIVERS NETWORK และ/หรือ ระงับการใช้รหัสประจำตัวดังกล่าวให้มีผลผูกพันผู้ใช้บริการและผู้ใช้บริการตกลงรับผิดชอบทุกประการ


2.3  บริษัทสงวนสิทธิที่จะตรวจสอบความถูกต้องของข้อมูลที่ผู้ใช้บริการกรอกสำหรับการเปิดชื่อผู้ใช้งาน และบริษัทอาจปฏิเสธการขอเปิดบัญชีผู้ใช้งานของผู้ใช้บริการ ที่ไม่ได้มีคุณสมบัต โดยผู้ใช้บริการไม่มีสิทธิโต้แย้งกับบริษัท


3.   การใช้ THE GIVERS NETWORK


3.1  ผู้ใช้บริการสามารถใช้ THE GIVERS NETWORK ได้ต่อเมื่อผู้ใช้บริการได้สมัครขอเข้าใช้งานในเว็บแอพพลิเคชัน (Web Application) ของ THE GIVERS NETWORK และเข้าถึงได้ด้วยเว็บบราวเซอร์ (Web Browser) โดยผู้ขอใช้บริการต้องกรอกข้อมูลที่จำเป็นเกี่ยวกับผู้ใช้งาน เพื่อสร้างบัญชีผู้ใช้งาน เช่น อีเมล (email) และกำหนดรหัสประจำตัว ตามวิธีที่บริษัทกำหนดไว้ และผูกพันปฏิบัติตามเงื่อนไขและข้อตกลงการใช้บริการที่บริษัทกำหนดขึ้นฉบับนี้ เงื่อนไขและข้อตกลงการใช้บริการที่อาจแก้ไขเพิ่มเติมได้ในอนาคต และรวมถึงข้อกำหนดเฉพาะตามแต่ละฟังก์ชันและ/หรือบริการ (ถ้ามี) ทั้งนี้ ให้ถือว่าข้อตกลง ข้อกำหนด และเงื่อนไขการใช้บริการดังกล่าวเป็นสาระสำคัญที่ผู้ใช้บริการต้องปฏิบัติตาม และหากบริษัทพบว่าผู้ใช้บริการรายใดไม่ปฏิบัติตาม บริษัทขอสงวนสิทธิที่จะปฏิเสธการสมัครสมาชิกของผู้ใช้บริการบางท่าน และบริษัทมีสิทธิยกเลิกการสมาชิกหรือระงับการใช้บริการของผู้ใช้บริการได้ตลอดเวลา หรือการใช้บัญชีผู้ใช้งานได้ในทันที


3.2 ในการเข้าใช้ THE GIVERS NETWORK ผู้ใช้บริการต้องใส่รหัสประจำตัว หมายความถึง บัญชีชื่อผู้ใช้งาน (User Name) รหัสผ่าน รหัสส่วนตัว หรือกรณีผู้ใช้บริการได้รับรหัส OTP (One Time Password) หรือการเข้าใช้งานด้วยไลน์ไอดี (Line ID Login) หรือ ระบบสมาชิกของกลุ่มบริษัทดีทีจีโอ (“DTGO FAMZ”) ให้ถูกต้อง พร้อมทั้งปฏิบัติตามขั้นตอน วิธีการ และ เงื่อนไขและข้อตกลงการใช้บริการที่บริษัทกำหนดอย่างถูกต้องครบถ้วนทุกครั้ง และหากกรณีใส่รหัสประจำตัวไม่ถูกต้องเกินจำนวนครั้งที่บริษัทกำหนด ระบบจะระงับการให้บริการชั่วคราว โดยผู้ใช้บริการต้องติดต่อบริษัทตามช่องทางที่กำหนด ทั้งนี้ ผู้ใช้บริการตกลงว่าการระงับการให้บริการชั่วคราวดังกล่าว โดยจะไม่มีผลเป็นการยกเลิกการทำรายการที่เป็นการทำคำสั่งไว้ล่วงหน้า และ/หรือรายการที่ทำเสร็จสิ้นตามขั้นตอนการใช้ THE GIVERS NETWORK แล้ว และผู้ใช้บริการตกลงจะไม่เรียกร้องค่าเสียหายใด ๆ กับบริษัทสำหรับการดำเนินการดังกล่าวทั้งสิ้น


3.3  ผู้ใช้บริการสามารถเข้าใช้งานฟังก์ชันต่าง ๆ โดยเฉพาะแต่ละบริการ ใน THE GIVERS NETWORK ที่บริษัทกำหนดและตามขั้นตอน วิธีการ และเงื่อนไขที่บริษัทกำหนด


3.4  บริษัทขอสงวนสิทธิ์ในการปฏิเสธคำขอยกเลิกการทำรายการที่ผู้ใช้บริการได้ดำเนินการเสร็จสิ้นแล้วตามกระบวนการที่ บริษัทได้กำหนด และการทำรายการดังกล่าวถือว่ามีผลผูกพันผู้ใช้บริการแล้ว


3.5  ผู้ใช้บริการตกลงว่าจะใช้ THE GIVERS NETWORK และ/หรือบริการของบริษัท เพียงเพื่อจุดประสงค์ที่ชอบด้วยกฎหมาย และสอดคล้องตามวัตถุประสงค์การให้บริการที่ระบุไว้เป็นลายลักษณ์อักษรโดยบริษัทเท่านั้น 


3.6  ผู้ใช้บริการซึ่งจะเป็นผู้ส่งข้อมูลเข้าผ่านระบบการสื่อสารของ THE GIVERS NETWORK ตกลงที่จะไม่ดำเนินการที่ขัดกับข้อห้ามที่บริษัทกำหนดไว้ ซึ่งหากทางบริษัทพบและพิจารณาด้วยดุลพินิจฝ่ายเดียวว่า ผู้ใช้บริการนำเสนอเนื้อหาที่ขัดกับเงื่อนไขและข้อตกลงฉบับนี้ บริษัทมีสิทธิที่จะไม่ยอมรับ ไม่ให้ความเห็นชอบ หรือกำหนดแก้ไขหรือลบข้อมูลเนื้อหาการนำเสนอที่ไม่สอดคล้องดังกล่าวออกจาก THE GIVERS NETWORK หรือระงับบัญชีผู้ใช้งานได้ทุกเมื่อ โดยไม่ต้องรับผิดชอบใดๆ ต่อผู้ใช้บริการในกรณีดังกล่าว และไม่ต้องแจ้งให้ผู้ใช้บริการที่เกี่ยวข้องทราบ

ก.    ห้ามนำเสนอเนื้อหาที่ผิดกฎหมายหรือศีลธรรมอันดี หมิ่นประมาท หยาบคาย อนาจาร เหยียดผิว เชื้อชาติ ศาสนา พระมหากษัตริย์ และ/หรือละเมิดสิทธิส่วนบุคคลของผู้อื่น ใช้ถ้อยคำยั่วยุ รุนแรง มีเจตนาแฝงอย่างอื่นนอกจากการใช้บริการ ดำเนินกิจกรรมใดๆที่เป็นโฆษณาชวนเชื่อหลอกลวงประชาชน หรือผิดกฎหมาย หรือที่เป็นการสนับสนุนการกระทำผิดกฎหมาย


ข.    ห้ามนำเสนอเนื้อหาที่เกิดจากการปลอมแปลงหรือลอกเลียน หรือการกระทำการใดๆ ที่เป็นการแสดงแก่บุคคลภาย นอกว่า ผู้ใช้บริการดังกล่าวเป็นผู้ใช้บริการอื่นที่ไม่ใช่ตนเอง ไม่ว่าด้วยจุดประสงค์ใด


ค.    ห้ามนำเสนอเนื้อหาที่ละเมิดสิทธิในทรัพย์สินทางปัญญาหรือสิทธิอื่นใดของผู้อื่น


ง.    ห้ามถอด ถอดรหัสคำสั่ง (Decompile) ทำวิศวกรรมย้อนกลับ หรือพยายามที่จะเข้าถึงรหัสคำสั่ง (Source code) ของ THE GIVERS NETWORK และ/ หรือ จะไม่คัดลอกส่วนใดๆ ของ THE GIVERS NETWORK และ/หรือนำไปใช้งานเชิงพาณิชย์ ให้เช่า ทำสัญญาเช่า ให้ยืม ขาย เผยแพร่ ให้อำนาจ ให้สิทธิช่วง แจกจ่าย มอบให้ หรือโอนแอปพลิเคชันส่วนใดๆ แก่บุคคลที่สาม


จ.    ห้ามนำเสนอเนื้อหาใดๆ ที่มีไวรัสคอมพิวเตอร์ ชุดคำสั่ง หรือโค๊ดคอมพิวเตอร์ใดๆ ไฟล์ หรือโปรแกรมอื่นๆ ที่ออก แบบไว้เพื่อทำลายหรือทำให้การทำงานของ THE GIVERS NETWORK หรือของผู้ใช้บริการอื่นได้รับผลกระทบ


ฉ.    ห้ามพิมพ์ ดาวน์โหลด ทำซ้ำ ส่ง คัดลอก ผลิตซ้ำ จัดส่งต่อ ตีพิมพ์อีก หรือใช้ข้อมูลใด ที่อาจทำให้สามารถระบุตัว ตนของผู้ใช้งานอื่น เช่น รูปถ่ายหรือภาพเคลื่อนไหวของผู้ใช้บริการอื่นที่ได้มีการแสดงผลใน THE GIVERS NETWORK ไม่ว่าด้วยเหตุผลใด เว้นแต่จะได้รับความยินยอมเป็นลายลักษณ์อักษรจากเจ้าของข้อมูล


4.   การคุ้มครองทรัพย์สินทางปัญญา


4.1  เนื้อหาทั้งปวงของ THE GIVERS NETWORK ของบริษัท รวมถึงแต่ไม่จำกัดอยู่เฉพาะสารสนเทศ ข้อความ กราฟิก ภาพ การ จัดวาง (layout) การออกแบบงาน (designs) รูปภาพ ตราสัญลักษณ์ เนื้อหาบทความ (editorial content) ภาษาที่ใช้ในการสร้าง โฮมเพจ และเอกสารในเวิร์ลด์ไวด์เว็บในอินเทอร์เน็ต (HTML) และองค์ประกอบในสาระอื่นบน THE GIVERS NETWORK เป็นทรัพย์สินทางปัญญาของบริษัท ซึ่งบริษัทสงวนสิทธิ์ในการบังคับใช้สิทธิในทรัพย์สินทางปัญญาของตนทั้งหมด ซึ่งรวมถึงแต่ไม่จำกัดเพียงการใช้สิทธิบังคับต่อการละเมิดสิทธิหรือเงื่อนไขการใช้ทรัพย์สินทางปัญญาโดยผู้ใช้บริการ


4.2  ผู้ใช้งานจะไม่ และจะไม่จัดหาให้มีการที่บุคคลที่สาม คัดลอก นำไปผลิตซ้ำ ส่งต่อ ตีพิมพ์ แพร่กระจาย แจกจ่าย นำออก ประกาศ เผยแพร่ เก็บ (ในรูปแบบวิธีการใด) แสดง ปรับเปลี่ยน ขายหรือโอน หรือร่วมในการขายหรือการโอน หรือการ เสนอขาย สร้างผลงาน ต่อยอด หรือแสวงหาประโยชน์ ในวิถีทางใดๆ จากเนื้อหาบน THE GIVERS NETWORK ของบริษัท ไม่ว่าทั้งหมดหรือ บางส่วน


4.3  กรณีที่ผู้ใช้บริการเป็นผู้นำเสนอเนื้อหาหรือข้อความใดๆ ผ่านทาง THE GIVERS NETWORK ผู้ใช้บริการต้องให้การรับประกัน และรับรอง แก่บริษัทว่า ตนเองมีสิทธิอย่างสมบูรณ์ในการนำเสนอเนื้อหาและข้อความต่างๆ ดังกล่าว และตกลงรับผิดและชดเชยความเสียหายใดๆ ที่อาจเกิดขึ้นกับบริษัท และ THE GIVERS NETWORK จากการนำเสนอข้อมูลดังกล่าว โดยครบถ้วน และผู้ใช้บริการรับทราบว่า บริษัทมีสิทธิแต่ไม่มีหน้าที่ในการตรวจสอบสิทธิและความถูกต้องดังกล่าว รวมถึงการสละสิทธิในการดำเนินการใดๆ ของบริษัทจะไม่ถือเป็นการสละสิทธิเด็ดขาดของบริษัท ในการดำเนินการต่อผู้ใช้บริการที่นำเสนอเนื้อหาหรือข้อความที่ไม่ถูกต้องดังกล่าว


5.   การระงับหรือยกเลิกการใช้บริการ


5.1 ในระหว่างที่ผู้ใช้บริการเข้าใช้บริการหรือเปิดบัญชีไว้กับ THE GIVERS NETWORK ผู้ใช้บริการตกลงและรับทราบว่าจะอยู่ภายใต้บังคับของเงื่อนไขและข้อตกลงฉบับนี้ จนกว่าจะมีการยกเลิกหรือปิดบัญชีผู้ใช้งาน ไม่ว่าการยกเลิกหรือปิดบัญชีผู้ใช้งานนั้นจะเกิดขึ้นด้วยเหตุใดก็ตาม


5.2 ผู้ใช้บริการรับทราบและยอมรับว่าบริษัทสงวนสิทธิ์ที่จะยกเลิกการให้บริการ หรือปิดบัญชีผู้ใช้งาน รวมถึงระงับการให้บริการ โดยไม่จำเป็นต้องแจ้งให้ผู้ใช้บริการทราบล่วงหน้า ในกรณีดังต่อไปนี้


ก. ผู้ใช้บริการใช้เอกสารปลอม หรือแสดงข้อความอันเป็นเท็จในการลงทะเบียนสมัครบัญชี รวมถึงการแจ้งข้อมูล หรือแสดงเอกสารหลักฐานอันเป็นเท็จ หรือแสดงเอกสารหลักฐานไม่ครบถ้วนตามที่บริษัทร้องขอ หรือ


ข. ผู้ใช้บริการถึงแก่ความตาย หรือกรณีสถานะภาพการจ้างงานของผู้ใช้บริการกับกลุ่มบริษัทดีทีจีโอ สิ้นสุดลง ทำให้สิ้นสุดการเป็น DTGO FAMZ บริษัทสงวนสิทธิ์ในการยกเลิกการให้บริการ หรือระงับการให้บริการในบัญชีผู้ใช้งานรายนั้น หรือ


ค. ผู้ใช้บริการเป็นผู้ถูกคำสั่งให้ยึดหรืออายัด ทรัพย์สิน หรือถูกกล่าวหา หรือถูกสงสัยว่าเป็นผู้กระทำความผิดตามกฎหมาย หรือ


ง. บริษัทมีเหตุสงสัยว่าผู้ใช้บริการกระทำความผิด หรือพยายามกระทำความผิดตามที่กฎหมายกำหนด หรือ กระทำการใด ๆ ที่อาจก่อให้เกิดความเสียหายกับบริษัท หรือบุคคลอื่นใด หรือ


จ. ผู้ใช้บริการประพฤติผิดหรือไม่ปฏิบัติตามเงื่อนไขข้อใดข้อหนึ่งที่กำหนดไว้ในเงื่อนไขและข้อตกลงฉบับนี้ หรือนโยบายคุ้มครองข้อมูลส่วนบุคคลหรือ นโยบายอื่นใดในการใช้บริการ หรือ


ฉ. บริษัทได้ทราบว่าผู้ใช้บริการตกเป็นผู้ไร้ความสามารถ หรือผู้เสมือนไร้ความสามารถตามกฎหมาย และไม่ได้รับความยินยอมจาก หรือกระทำการแทนโดยผู้ดูแลตามกฎหมายของผู้ใช้บริการในการสมัครและใช้บริการตามเงื่อนไขและข้อตกลงฉบับนี้


5.3 บริษัทไม่มีส่วนเกี่ยวข้องหรือรับผิดชอบในความเสียหายที่จะเกิดขึ้นทั้งหมดอันเนื่องมาจากการระงับ และ/หรือยกเลิกการใช้บริการ และ/หรือปิดบัญชีผู้ใช้งานดังกล่าว


6.   ข้อจำกัดความรับผิดของบริษัท


6.1  ภายใต้กฎหมายที่ใช้บังคับบริษัท และบริษัทในเครือ เจ้าหน้าที่ กรรมการ พนักงาน หรือตัวแทน ไม่มีความรับผิดในความเสียหายใด ทั้งในกรณีใดๆลักษณะใดๆก็ตาม ต่อผู้ใช้งาน ไม่ว่ารายใดสำหรับความเสียหายที่ไม่ใช่ความเสียหายทางตรงอันเกิดจากการกระทำผิดโดยจงใจ หรือประมาทเลินเล่ออย่างร้ายแรงโดยบริษัท หรือความเสียหายทางอ้อม หรือเกี่ยวเนื่องไม่ว่าลักษณะใด


6.2  บริษัท โดยการให้บริการผ่าน THE GIVERS NETWORK และส่วนประกอบทั้งหลายนั้นได้รับการจัดให้มี “ตามที่เป็น”และ“ตามที่มี” (As Is Basis)เท่านั้นดังนั้นเท่าที่กฎหมายที่ใช้บังคับพึงอนุญาตสูงสุดบริษัทปฏิเสธโดยชัดแจ้งซึ่งคำรับรองและการรับประกัน ทั้งหมดไม่ว่าประเภทใด ๆ อันเกี่ยวกับ THE GIVERS NETWORK ไม่ว่าโดยชัดแจ้งหรือโดยปริยาย รวมถึง แต่ไม่จำกัดเฉพาะ การรับประกัน ใด ๆ และทั้งหมดเกี่ยวกับ (1) สภาพการใช้ประโยชน์ในเชิงพาณิชย์และความเหมาะสมสำหรับวัตถุประสงค์เฉพาะของแต่ละผู้ใช้บริการ (2) การรับประกันว่า THE GIVERS NETWORK จะสามารถใช้งานโดยปราศจากการสะดุด ความล่าช้า ความไม่ถูกต้อง แม่นยำ หรือปราศจากช่วงเวลาที่เซิร์ฟเวอร์ล่มหรือความผิดปกติเทคนิคทั้งหมด (3) การรับประกันว่า THE GIVERS NETWORK ปลอดภัย หรือปราศจากไวรัสหรือส่วนประกอบอื่นที่ก่อให้เกิดอันตราย (4) การรับประกันว่า THE GIVERS NETWORK จะตรงตามความต้องการหรือ ความคาดหวังของผู้ใช้บริการทุกส่วน และ (5) การรับประกันว่า สารสนเทศ ข้อมูล หรือสื่อวัสดุที่แสดงหรือปรากฏใน THE GIVERS NETWORK ทั้ง หมดนั้นถูกต้อง แม่นยำ และเชื่อถือได้


6.3  ผู้ใช้บริการตกลงและยอมรับว่า บริษัทไม่ต้องรับผิดชอบในความผิดพลาด ความบกพร่อง หรือเหตุขัดข้องในการใช้บริการ อันเนื่องมาจากการที่ผู้ใช้บริการใช้ THE GIVERS NETWORK เพื่อการทำรายการไม่เป็นไปตามที่บริษัทกำหนด หรือเกิดจากเหตุสุด วิสัย หรือเหตุอื่นใดที่อยู่นอกเหนือการควบคุมของบริษัท


6.4 ผู้ใช้บริการยอมรับและตกลงรับทราบว่า THE GIVERS NETWORK อาจแสดงหรือเชื่อมโยงไปยังเว็บไซต์ หรือ แอปพลิเคชัน(Application) หรือบริการอื่นที่ เป็นของบุคคลที่สาม แต่บริษัทไม่ได้ให้การรับรองในเนื้อหาและการทำงานหรือดำเนินการของเว็บไซต์ หรือ แอปพลิเคชัน (Application) หรือบริการของ บุคคลภายนอกดังกล่าว และบริษัทจะไม่รับผิดชอบหรือมีภาระรับผิดต่อความสูญเสียหรือความเสียหายใด ๆ ในลักษณะ ใดที่เกิดขึ้นกับหรือเกี่ยวข้องกับผู้ใช้บริการจากการใช้บริการของเว็บไซต์ หรือ แอปพลิเคชัน (Application) หรือบริการอื่นที่เป็นบุคคลที่สาม นั้น


7. ข้อกำหนดอื่น ๆ


7.1  ผู้ใช้บริการยืนยันว่า email address ตามที่ผู้ใช้บริการได้ระบุไว้ใน THE GIVERS NETWORK เป็น email address ที่สามารถเข้าถึงผู้ใช้บริการได้ตลอดเวลา ทั้งนี้ ผู้ใช้บริการรับทราบว่า การติดต่อใด ๆ จากบริษัทที่ส่งไปยังผู้ใช้บริการ ตามที่อยู่ email address ที่ผู้ใช้บริการได้ระบุไว้ ถือว่า เป็นการแจ้งให้แก่ผู้ใช้บริการทราบด้วยวิธีที่ถูกต้องและให้ถือว่าผู้ใช้บริการได้รับการติดต่อดังกล่าว ตั้งแต่วันที่ส่งการติดต่อดังกล่าวแล้ว ทั้งนี้ เมื่อผู้ใช้บริการเปลี่ยนแปลงข้อมูลใด ๆ ที่เกี่ยวข้องที่ระบุไว้เดิมในขณะสมัครใช้ THE GIVERS NETWORK จะต้องแจ้งให้บริษัททราบเป็นลายลักษณ์อักษรตามช่องทางที่บริษัทกำหนด

      กรณีผู้ใช้บริการประสงค์จะแลกของรางวัลหรือทำกิจกรรมหรือร่วมแคมเปญหรือติดต่อกับองค์กรหรือสปอนเซอร์ ผู้ใช้บริการรับทราบว่า ข้อมูลการติดต่อและช่องทางการติดต่อใดๆ ที่กำหนด ระหว่างองค์กรหรือสปอนเซอร์กับผู้ใช้บริการ ผู้ใช้บริการจะตกลงรายละเอียดของข้อมูลติดต่อแก่องค์กรหรือสปอนเซอร์โดยตรง และยอมรับและผูกพันตามข้อตกลงและเงื่อนไขระหว่างองค์กรหรือสปอนเซอร์กับผู้ใช้บริการ


7.2  เงื่อนไขและข้อตกลงฉบับนี้จะถูกบังคับใช้และตีความตามกฎหมายของประเทศไทย กรณีมีข้อพิพาทใด ๆ เกี่ยวเนื่องเกิดขึ้น ข้อพิพาทดังกล่าวอาจระงับโดยศาลแพ่งในประเทศไทย


7.3  ผู้ใช้บริการตกลงให้บริษัทมีสิทธิเพียงฝ่ายเดียว ในการเพิ่มหรือแก้ไขเปลี่ยนแปลงเงื่อนไขและข้อตกลงการใช้บริการ รวมทั้ง ค่าธรรมเนียม ค่าใช้บริการ และค่าใช้จ่ายเกี่ยวกับการใช้ THE GIVERS NETWORK ได้ตามแต่จะเห็นสมควร โดยผู้ใช้บริการตกลงผูกพันปฏิบัติตามเงื่อนไขและข้อตกลงการใช้บริการ โดยบริษัทไม่จำเป็นต้องแจ้งให้ผู้ใช้บริการทราบล่วงหน้า ทั้งนี้การเปลี่ยน แปลงดังกล่าวจะมีผลบังคับใช้ต่อเมื่อมีการประกาศผ่านทาง THE GIVERS NETWORK และหากการเปลี่ยนแปลงดังกล่าวจะมีผลกระทบ โดยตรงต่อสิทธิและ/หรือหน้าที่ของผู้ใช้บริการ บริษัทจะแจ้งให้ผู้ใช้บริการทราบล่วงหน้าเพื่อปฏิบัติตาม


7.4  เงื่อนไขและข้อตกลงฉบับนี้แต่ละข้อมีผลบังคับแยกจากกัน ในกรณีที่บทบัญญัติข้อใดหรือบางส่วนไม่ชอบหรือจะไม่ชอบด้วยกฎหมาย เป็นโมฆะ หรือไม่สามารถบังคับใช้ได้ บทบัญญัติอื่นหรือข้อกำหนดและเงื่อนไขอื่น ๆ ที่เหลือ จะยังคงมีผลสมบูรณ์ และสามารถบังคับใช้ได้


7.5  เงื่อนไขและข้อตกลงฉบับนี้เขียนและตกลงกันในภาษาไทย ซึ่งจะเป็นภาษาที่จะบังคับใช้ในการตีความ วินิจฉัย และในกรณีที่มีความไม่สอดคล้องกันในประการใดประการหนึ่งระหว่างฉบับภาษาไทยและฉบับแปลในภาษาอื่น

Terms and Conditions

 

DTGO Corporation Limited (“Company”) is the owner of THE GIVERS NETWORK PLATFORM (“THE GIVERS NETWORK”). The purposes of THE GIVERS NETWORK are to connect between Users (a) General Users (b) Users who are the member of DTGO group of company ("DTGO FAMZ”) and Organizations, Sponsors, Supporters and/or any charities related to supporting the society, to create awareness for social responsibility, to give opportunities for education, public health, and environmental protection through using communication technologies that allow people to connect with each other. When you successfully apply for a User account, it is regarded as a THE GIVERS NETWORK User (“User” or “Users”) and Users agree to be bound by and comply with these Terms and Conditions.

 

If Users fail to comply with these Terms and Conditions or any of their future amendments, the Company reserves the right to prohibit or not allow the Users to use the services from THE GIVERS NETWORK.  In a similar manner, active users of THE GIVERS NETWORK is deemed as an invariable acceptance to these Terms and Conditions.

 

Users acknowledge that in addition to these Terms and Conditions, the use of service on THE GIVERS NETWORK requires Users’ personal data to be collected, used, disclosed, and managed by the Company (collectively referred to as “data processing”) for the purpose of the provided services. The Company has separately constituted this data processing terms in the Privacy Policy.

 

1.      Use of Services and Functions of THE GIVERS NETWORK  

 

Under functions of THE GIVERS NETWORK, the Company provides these following services to Users and their organizations (“Organizations”) namely the hosting of activities and volunteering campaigns to foster public societies and giving opportunities to uplift education, public health, and environmental protection (“Activities”.) For the avoidance of doubt,, Organizations are to determine their own set of rules and conditions for participation in Activities hosted by them, which includes giving rewards to each Activities and redemption mechanisms that managed by Organizations or Sponsors. In this instance, the Company is only responsible for the connection between them.

 

1.1         THE GIVERS NETWORK is a communicative platform in the Point accumulation system for the Users (collectively referred to as “Point"). There are two types of Points which are (A) Experience Points or EXP will be earned through participation in Activities or fulfilling specific conditions and terms regarding to each personnel and will be earned amongst all Users in the same Guild or overall Organizations to display a scoreboard that may contain the sum of Experience Points accrued by a department, division, group, or Guild (“Experience Points” or “EXP”) (B) Boon Points  system to accumulate Do good Points (collectively referred to as “Boon") receivable via participation in Activities or conditions and terms regarding to Point system Boon is unacceptable to buy, sell, or exchange between Users or exchange for cash or anything else unless it can be used to redeem rewards or be used according to the conditions that shall be determined.

 

1.2         THE GIVERS NETWORK administers a Points accumulation system based on the rules and conditions determined by each Organizations. This system is functioned under the following conditions:

 

A. The Organizations shall be the sole authority to determine Conditions for Points accumulation. The Company is only responsible for the administration of tools for such execution as following that conditions and will not be liable for any problems or disputes arise in connection with the conditions, whereby Users are to make direct contact with the host Organization of Activities by themselves;

 

B. Information pertaining to the participation in Activities for Points accumulation purpose is to be submitted directly by Users and will then only be displayed by the Company. Users are responsible for checking f the correctness of information and make sure it does not violate the others’ rights or engage with any unlawful actions. In this regard, Users and Organizations understand and agree that the Company does not need to check for the correctness of information submitted by Users through THE GIVERS NETWORK system. If the information has been successfully submitted in accordance with the conditions determined by the Organization, the system will immediately honor Points to the associated User and this process is not to be construed that the information is correct or incorrect in any manner; and

 

C. Information pertaining to the participation in Activities is to be confirmed directly by Organizations who arrange the Activity and person who specifies the Campaign conditions . In case of disputes between Users and Organizations who arrange the Activity and person who specifies the Campaign conditions, the Company will only act as a communicative intermediary and will not be liable for any responsibilities. Any action by the Company in this instance is not to be construed as a validation of information successfully submitted by one of the disputing parties within the limited timeframe. The Company has the right to deduct Points from Users as far as the conditions of Organizations who arrange the Activity and who specifies the Campaign conditions allow and Users acknowledge and are bound to comply. Users whose Points are deducted have no right to dispute with the Company.


D. In the event that arrangement of the participation in Activity for a donation, Users agree and accept that Organizations may request additional necessary information to support the issuance of documents or delivery of any documentary evidence such as first name and last name, address, ID card number, phone number, etc.

 

1.3 THE GIVERS NETWORK administers Boon’s redemption system that allows Users to redeem Boon for rewards (“Rewards”) under the conditions may be determined by Organizations. Users and Organizations understand and agree that the Company does not provide, supply, or deliver the Rewards to Users. The Company only facilitates the display of collecting Boon and serves as a platform for Users to initiate their redemption request. The Company is not liable for responsibilities, whether direct or indirect, or any legal obligations to guarantee that Users are entitled to or will receive the Rewards which includes, but not limited to, the ownership, tradability, conformity of designs, flaws in product or service, quality, decency, or infringement of copyright. Users are to comply with the conditions of redemption determined by the Organizations, Supporters that supply the Rewards, Rewards Suppliers, Sponsor (collectively referred to as “Sponsors”) and file their claims and delivery of Rewards that Sponsors have own selection directly with them.

 

2.      Users Account and Password

 

2.1 Users agree to keep their account and password confidential and not disclose them to anyone. The Company reserves the right not to be liable for any damage incurred from the actions of a third person without consensual approval. In this case, Users are to immediately notify the Company for the latter to suspend transactions and/or use of THE GIVERS NETWORK upon identity verification process specified by the Company;

 

2.2 Users agree that the transactions or activities on THE GIVERS NETWORK completed prior to the suspension and/or use of THE GIVERS NETWORK and/or their password by the Company are construed as their doings and responsibilities in all aspects; and

 

2.3 The Company reserves the right to check for the correctness of information submitted by Users when they register for an account and may deny account registration attempt that does not meet the criteria determined by the Company. Those who have their account registration attempt denied have no right to dispute with the Company.

 

3.      Use of THE GIVERS NETWORK

 

3.1 Users can use THE GIVERS NETWORK on Web Application which is accessible via Web Browser. Users must complete the registration process by filling in the required information such as email and identification codes per criteria specified by the Company. In registration for an account, Users are bound by these Terms and Conditions or any of their future amendments and specific principles for each product and/or service, if any. Users are to comply with all the relevant agreements, contracts, and rules for the use of THE GIVERS NETWORK . The Company reserves the right to deny account registration attempt and revoke or terminate an account at any time and with immediate effect should Users fail to comply with all the mentioned rules;

 

3.2 Users must correctly log-in with either their identification codes which includes username, password, personal code and OTP or log-in with Line ID or DTGO group of company (“DTGO Famz") account to use THE GIVERS NETWORK and must comply with all the relevant agreements, contracts, and rules specified by the Company at all times. If the identification codes are entered wrongly for more than the limit set by the Company, the system will automatically block that log-in attempt for a period and Users are required to contact the Company to reclaim their account accessibility. Users agree that during the User Account’s suspension, their advance transactions and/or pending activities will not be prompted canceled and they will not ask for any compensation with the Company;

 

3.3 Users can access functions in each service on THE GIVERS NETWORK via methods and processes per the announcement specified by the Company;

 

3.4 The Company reserves the right to reject a cancellation request on transactions already completed by Users and those transactions are also considered binding to Users;

 

3.5 Users agree to use THE GIVERS NETWORK and/or services provided by the Company only for lawful purposes and other objectives that the Company specifies in written notice;

 

3.6 Users must only submit THE GIVERS NETWORK with information that does not obstruct the criteria specified by the Company. The Company has sole authority to determine whether to approve or to disapprove, refuse, deny, or amend or delete any piece of information that goes against THE GIVERS NETWORK or suspend the User Account at any time and with immediate effect without the need to inform Users beforehand. The criteria are as follows:

 

A. Content that is illegal, immoral, defamatory, vulgar, obscene, or associates with discriminatory perceptions such as race, religion, and monarchs are prohibited. This includes the violation of privacy, use of provocative or violent words with harmful intent, and carrying out of misleading advertising, illegal activities or those that support unlawful actions;

 

B. Content that is forged, counterfeit, or stands to represent to the third parties that Users are impersonating another individual regardless of intents is prohibited;

 

C. Content that infringes the intellectual property rights and/or any rights of others is prohibited;

 

D. Actions to disassemble, decompile, reverse engineer, or access to the source code of THE GIVERS NETWORK without prior approval are prohibited. This includes a copy of THE GIVERS NETWORK content, whether partly or wholly, for commercial purposes to any third party or to offer them to borrow, lease, lend, sell, publish, authorize, sublicense, distribute, assign or transfer any portion of the platform;

 

E. Content that contains viruses, software with malwares, computer codes, files, or any programs that damage or render the functions of THE GIVERS NETWORK or Users is prohibited; and

 

F. Actions to reprint, download, reproduce, transmit, copy, reproduce, redistribute, republish or other uses of any information that may be identifiable as Users such as photographs or motions that are displayed in THE GIVERS NETWORK regardless of intents are prohibited, unless allowed otherwise by the owner of such information in written notice.

 

4.      Protection of Intellectual Property Rights

 

4.1 The entirety of content on THE GIVERS NETWORK which includes, but not limited to, computer information, graphics, texts, pictures, layout, designs, photos, signs, editorial content, languages, homepages, HTMLs, and other elements contained on THE GIVERS NETWORK are intellectual property of the Company. The Company reserves the right to take enforcement of intellectual property right and that includes litigation for infringement or impediment of intellectual property rights by Users;

 

4.2 Users will not, by themselves nor any third party, copy, reproduce, transmit, publish, distribute, deliver, release, exhibit, announce, store (in any method and whatsoever), display, modify, sell, transfer, participate in a sale, create derivative, or exploit the content on THE GIVERS NETWORK in any way; and

 

4.3 For the publication and production of content on THE GIVERS NETWORK, Users guarantee that they are fully liable and will compensate the Company and THE GIVERS NETWORK for any damage incurred from such actions. Users also agree that the Company has the right in association with those content despite the need to validate nor check for its correctness. Any waiver of rights by the Company does not construe to the absolute waiver of other rights to take legal action against Users who publish or produce incorrect content.

 

5.      Suspension or termination of service


5.1 During the time that the Users access the service or open an account with THE GIVERS NETWORK, the Users agree and acknowledge that they will be subject to the Terms and Conditions, until the account is canceled or closed, regardless of the reason for the cancellation or closure of the account.

5.2 The Users acknowledge and agree that the Company reserves the right to cancel the service, close the account, or suspend the service without having to notify the User in advance in the following cases;


A. The Users use forged documents or provides false information when registering for the account, including providing false information or providing false or incomplete supporting documents as requested by the company; or


B. In the event of the death of the Users or the termination of the user's employment status with the group of companies of DTGO, resulting in the termination of their employment (DTGO FAMZ), the Company reserves the right to cancel or suspend the service in the account.


C. The User has been ordered to seize or freeze assets, or has been accused or suspected of being a perpetrator of a crime under the law; or


D. The Company has reason to believe that the user has committed or attempted to commit a crime under the law, or has taken any action that may cause damage to the Company or any other person; or


E. The Users misbehave or fail to comply with any of the conditions specified in these Terms and Conditions, or the personal data protection policy or any other policy for using the service; or


F. The Company has known that the Users are incapacitated or quasi-incapacitated under the law and have not received consent from or acted on behalf of the legal guardian to apply for and use the service under these Terms and Conditions.


5.3 The Company shall not be involved in or responsible for any damages that may arise in any way from the suspension and/or cancellation of the use of the service and/or the termination of the user's account.


6.      Scope of Responsibility by the Company

 

6.1 Within the highest extent constituted by the governing laws, the Company, its Affiliates, personnel, directors, employees, or representatives hold no responsibility in all manners and respects or whatsoever for damages caused by negligence or carelessness, whether with intention or without intention, by any of the Users that impacted the Company;

 

6.2 The Company through its services rendered by THE GIVERS NETWORK and the related components are provided on an as is basis. The Company is therefore, within the highest extent constituted by the governing laws, denies responsibility to guarantee and assure in all manners that (1) THE GIVERS NETWORK is used for commercial purposes and personalized suitability for each User; (2) THE GIVERS NETWORK can be used smoothly without any glitch, delay, incorrectness, system downtime, or other technical malfunctions; (3) THE GIVERS NETWORK is safe without viruses or other components that could cause damage; (4) THE GIVERS NETWORK will meet all the needs and expectations of Users; and (5) the information, data, or medias displayed on THE GIVERS NETWORK  are correct, accurate, and trustworthy;

 

6.3 Users agree and accept that the Company has no need to compensate for mistakes, problems, or malfunctions of services that caused by Users when they make a transaction that fails to comply with the relevant agreements, contracts, and rules specified by the Company or any force majeure events beyond the Company’s control; and

 

6.4 Users agree and accept that the use of THE GIVERS NETWORK may redirect or connect Users to websites, applications, or services provided by the third party without content certification. The Company holds no responsibility nor obligation to compensate Users for any damage incurred during their access to such websites, applications, or services provided by the third party.

 

7.      Miscellaneous

 

7.1 Users confirm that the email address they have given in THE GIVERS NETWORK which is contactable at all times. Users also acknowledge that any contact made by the Company to them per that given email address shall be considered appropriate and duly delivered since the date of initial stage of communication. If Users want to make amendment to any of the information completed during registration of THE GIVERS NETWORK, they must notify the Company in written notice via the specified communication channels;

In the event that Users wish to redeem Rewards or participate in Activities or participate in Campaigns or contact Organizations or Sponsors, Users acknowledge that contact information and any designated channels of contact between Organizations or Sponsors and the Users, Users will directly agree the details of the contact information to Organizations or Sponsors and accept and be bound by the Conditions between Organizations or Sponsors and Users.

 

7.2 These Terms and Conditions shall be governed and construed in accordance with the governing laws of Thailand and any disputes shall be resolved by the Civil Court of Thailand;

 

7.3 Users agree that the Company has sole authority to add or make amendments to these Terms and Conditions as well as service fees and other costs related to THE GIVERS NETWORK as appropriate without prior notice and Users are also to be bound by and comply with the edited Terms and Conditions. Any change to these Terms and Conditions will only come into effect when the announcement on the specified communication channels of THE GIVERS NETWORK has been made. If there is direct impact on the rights and/or duties of Users incurred from the changes to these Terms and Conditions, the Company shall inform Users beforehand to cater for appropriate compliance period;

 

7.4 If any part of these Terms and Conditions is void or is legally invalid, the rest of the whole part of these Terms and Conditions shall be deemed separate from the void or legally invalid parts and continue to be in effect; and

 

7.5 These Terms and Conditions are constructed in Thai language. Thai language is therefore to be interpreted and adhered should there be any inconsistency of languages or translations.
